Can I claim compensation for a stroke?

Medical negligence lawyer Oliver Thorne looks at claiming compensation for a stroke.

Strokes and medical negligence

Anyone who suffers a stroke may be entitled to claim compensation if their condition has been caused or made worse by sub-standard medical care.

A common basis for a clinical negligence claim to be made is where medical professionals have failed to identify the warning signs of an impending stroke. By failing to diagnose the condition correctly the patient may suffer a stoke that could have been avoided altogether, or the effects of the stroke may be worse than they would have been if a more timely medical intervention had been made.

This is particularly relevant where a major stroke has been preceded by a ‘transient ischaemic attack’ or TIA. These involve a temporary interruption of the blood supply to the brain, giving rise to short-lived stroke symptoms. TIAs act as a warning. If they are diagnosed and immediately treated (aspirin is commonly used) then a full stroke may be avoided.

Strokes can also be brought about by the incorrect prescription of medication.

Claiming compensation for a stroke on a No Win, No Fee basis

We deal with stroke compensation claims on a No Win, No Fee basis, acting for patients nationwide. This means that you do not need to let financial concerns about paying legal costs put you off seeking justice.

Under our No Win, No Fee scheme we fund all expenses, such as the costs of medical reports, and if you do not succeed in your claim then you won’t owe us a penny.

How much compensation can I claim?

Each case is assessed individually, and the amount of compensation will be linked to the severity of your injuries and the financial impact it has on your life. So, in addition to receiving an award for your ‘pain and suffering’, we can also recover lost earnings and the cost of rehabilitation, housing adaptions, transport and technology needs, and care.

 How we can help

We will assess your claim free of charge and if it’s a case we believe we can help you with then we will provide details of our No Win, No Fee funding scheme.
