Mia Nicholson, a member of our specialist medical negligence team, has successfully settled a claim for her client involving a negligently performed bilateral salpingo-oophorectomy. This procedure involves removing:
- the fallopian tubes (salpingectomy)
- the ovaries (oophorectomy)
Unfortunately, the surgery led to the development of a hernia and a small bowel obstruction, ultimately requiring our client to undergo two additional surgical procedures.
To support the claim, Mia sought the opinions of experts in hepatobiliary and major trauma, as well as in gynecology. Both medical experts were supportive of her client’s case. Mia then proceeded to contact the NHS Trust, alleging that the hospital had failed to adequately close the surgical site after the procedure. Additionally, it was claimed that the hospital did not provide written information to our client regarding which post-operative symptoms should prompt her to seek further medical attention, particularly concerning ongoing abdominal pain and vomiting.
We argued that if the original surgery had been performed to an appropriate standard, our client could have avoided suffering from the hernia, the small bowel obstruction, and the subsequent need for two additional operations.
Unfortunately, the NHS Trust denied liability and continued to defend the claim. As a result, Mia started court proceedings.
After further correspondence with the NHS Trust, a settlement offer was made by us which was accepted by the NHS, successfully concluding the claim out of court.
