Medical accident, Taunton. Case study of woman who successfully sued Musgrove Park Hospital in Taunton, for a medical accident in the operating theatre
We were retained by the Claimant following a failed endometrial ablation procedure at the Musgrove Park Hospital in Taunton.
During the procedure a nurse tripped over a cable that was attached to the hysterscope. This caused fluid to leak from the instrument which at the time was inside the Claimant’s womb.
As a result of the medical accident the leaked fluid burnt the Claimant’s cervix and the site of the burn subsequently became infected.
We agreed to pursue a medical accident compensation claim against the hospital on a No Win – No Fee basis.
Following an agreement with the hospital to extend the 3 year time period to bring a claim, negotiations took place.
Having been presented with a strong case the hospital accepted responsibility for the Claimant’s injuries.
Following the hospital’s admission of fault for the medical accident, steps were subsequently taken to quantify the value of the compensation claim. Expert medical evidence was also obtained.
After lengthy discussions with the hospital's legal representatives an agreement was finally reached for an out of court settlement of the Claimant’s medical accident claim. She received a sum of £35,000.00, together with payment of her legal costs.
