This is a real-life case study of a successful claim for compensation for testicular torsion.
In this case study we look at successful claim for compensation following delayed diagnosis of testicular torsion.
Background to the testicular torsion claim.
Ms W had taken her son to the GP after suffering from pain and swelling in his left testicle, which had come on while he was at school. The GP referred him to the local hospital. He had an examination and “testicular torsion” was noted. A consultant urologist reviewed the case and concluded that it was not a torsion. Our client was sent home, and asked to return the following day for an ultrasound scan.
The ultrasound scan revealed a heterogeneous solid mass in the upper pole of the left testis. Our client was given pain relief, told to go home and return in three weeks for a further ultrasound scan.
Two days later, our client returned to the hospital after experiencing more swelling in his left testicle and was sent for another scan. The scan revealed testicular torsion and our he underwent an orchidectomy and right orchidopexy on the same day.
The medical negligence claim
When testicular torsion arises, it is very important to operate as soon as possible to avoid more damage to the testicle and the need to have the testicle removed. We have handled many testicular torsion cases and were able to use our experience to assist Ms W and her son on a No Win, No Fee basis.
We submitted allegations of negligence to the hospital trust, including their failure to diagnose the torsion on the first presenting day at the hospital, arguing that if this had been done, the orchidectomy would have been avoided.
We also instructed a psychosexual therapist for a report on the consequences of the negligence.
The hospital trust admitted liability, and following negotiations an out of court settlement was reached, with our client receiving £32,500 for his injuries.
