Diagnostic Delay Claims

This is often inextricably linked to cases of misdiagnosis, but it can also be the foundation of a medical negligence claim in its own right. The legal duty of care in medical matters applies to all clinicians, and this has been extended to just about anyone who works in a medical environment, from the top neurosurgeon carrying out delicate brain surgery, down to the hospital porter wheeling a patient on a trolley. Therefore, there is no doubt that it also extends to people such as laboratory technicians, radiographers, and others responsible for the chain of investigation that leads to diagnosis- even the surgery administrative staff.
 
If an unreasonable, unjustifiable delay occurs in actually making or communicating a diagnosis or providing medical treatment; and if because of it the patient’s chances of recovery are hindered or he suffers illness or injury that could otherwise have been avoided, then there may be a claim for medical negligence compensation.
